1. About these terms
These Terms and Conditions (“Terms”) apply to your use of tramwayglobal.com and to quotations, orders and sales of vehicles, trucks, machinery, heavy equipment and parts by Tramway Enterprises Corporation (“Tramway”, “we”, “us”), based at Tipo High Tech Park, Subic Freeport Zone, SBMA, Philippines. By using this website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.
2. Using our website
- You must be at least 18 years old, or use the website on behalf of a business that has authorised you to do so.
- You agree not to misuse the website, attempt to gain unauthorised access, send spam or submit false information.
- If you create an account, keep your login details confidential. You are responsible for activity under your account.
3. Listings and vehicle information
- We describe each unit as accurately as we can, but specifications, mileage, condition, photos and features are provided for guidance and may contain errors. Please confirm the details that matter to you with our team before ordering.
- Photos may be representative of the model and not of the exact unit, where stated.
- Listing a unit is an invitation to make an inquiry, not a binding offer. Stock is subject to prior sale, and availability statuses (Available, Reserved, Sold, Coming Soon) may change without notice.
4. Prices and quotations
- Prices are shown in US Dollars (USD) unless stated otherwise and may change without notice until confirmed in a written quotation or proforma invoice.
- Unless stated in your quotation, prices do not include shipping, freight, insurance, inspection, import duties, taxes, port or registration charges in the destination country.
- A quotation is valid for the period stated on it. We may correct obvious pricing errors.
5. Orders and contract
A sale becomes binding when we issue a written confirmation, proforma invoice or sales contract and receive your payment as set out in it. If the terms of your sales contract or invoice differ from these Terms, the sales contract or invoice applies to that sale.
6. Payment terms
- Payment terms are 100% T/T (telegraphic transfer) in advance, unless we agree otherwise in writing.
- All bank charges outside the Philippines must be borne by the Buyer.
- Payments must be made only to the account shown on our Bank Details page or on your official invoice. We will never change our bank details by email alone. Always call us to verify any new payment instructions. We are not responsible for payments sent to an account not confirmed by us.
- A unit is released for shipment or collection only after full payment has been received in our account.
7. Delivery, shipping and export
- Delivery, shipping and collection terms, including the agreed Incoterm, port and estimated dates, are set out in your quotation or sales contract. Dates are estimates and may be affected by shipping schedules, port conditions, inspections or events outside our control.
- Unless agreed otherwise, the Buyer is responsible for import duties, taxes, customs clearance and registration in the destination country.
- The Buyer is responsible for confirming that the vehicle or equipment (including left-hand-drive configuration, age, emissions and other requirements) may legally be imported and used in the destination country.
- Risk passes to the Buyer as set out in the agreed Incoterm or sales contract.
8. Inspection, condition and warranty
- Buyers are encouraged to inspect a unit, or arrange an independent inspection, before purchase. Viewings can be requested through our website.
- Second-hand vehicles, machinery and equipment are sold in their present condition (“as is”), unless a written warranty is provided in your sales contract.
- Brand-new units carry only the warranty, if any, stated in writing in your sales contract or provided by the manufacturer.
9. Cancellations and refunds
Cancellations, refunds and returns are handled according to the terms of your sales contract or proforma invoice. Because units are often prepared, documented and shipped specifically for each buyer, an order may not be cancellable once payment has been received or shipment has been arranged. Please discuss any concerns with us before you pay.
10. Limitation of liability
To the extent permitted by law, Tramway is not liable for indirect or consequential loss, loss of profit or business, or for delays or losses caused by shipping lines, authorities or events outside our reasonable control. Our total liability for any sale is limited to the price paid for the unit concerned. Nothing in these Terms limits liability that cannot be limited under Philippine law.
11. Intellectual property
The Tramway name, logo, website content and design belong to Tramway Enterprises Corporation or are used with permission. You may not copy or reuse them without our written consent. Some photos are licensed from third parties.
12. Privacy
Our Privacy Policy explains how we collect and use your personal information.
13. Governing law
These Terms and any sale are governed by the laws of the Republic of the Philippines. Disputes will be submitted to the competent courts of the Philippines, unless your sales contract provides otherwise.
14. Changes to these terms
We may update these Terms from time to time. The version on this page at the time of your order applies to that order.
